A 91-year-old man has been ordered to stand trial for allegedly causing the death of eight-year-old Scarlett Rossborough in Carrickfergus last year.

The tragic incident occurred on August 9, 2023, when Scarlett was struck and killed while walking with a group of children along High Street in Carrickfergus. The incident took place shortly before noon, shaking the local community.

John Noble Lindsay, of Prince Andrew Way, Carrickfergus, appeared via video link from his home during the preliminary enquiry at Belfast Magistrates’ Court. The court session was attended by family and friends of the late Scarlett Rossborough, who watched the proceedings from the public gallery.

Lindsay is charged with causing Scarlett’s death by driving dangerously on High Street. When asked by the court clerk if he understood the charge, Lindsay, dressed in a blue jumper, replied, “I do, Your Worship.” He chose not to respond further to the charge and did not present any evidence or call witnesses on his behalf.

A prosecution lawyer stated that, based on the available evidence, there was a prima facie case against Lindsay. Defence barrister Stephen Molloy informed the court that Lindsay, currently recovering from a recent stomach operation, was appearing via video link for health reasons.

“We are very eager for this case to proceed, and I know the family wishes for it to move as quickly as possible as well,” said Molloy.

District Judge Keown confirmed there was a case to answer and ordered the case to be returned to Belfast Crown Court for an arraignment hearing on a date yet to be determined. Lindsay was released on his own bail of £500, without the requirement to sign for it.

Molloy applied for legal aid for Lindsay, revealing that the defendant had £1,000 in the bank, £91,000 in an ISA, and £180,000 in home equity. However, Judge Keown denied the legal aid application at this stage, allowing for a fresh application once the case reaches Belfast Crown Court.

Scarlett Rossborough, who hailed from Larne, attended Linn Primary School. Following her death, teachers remembered her as “a much-loved pupil” known for her “infectious giggles and sense of fun.” The school noted that Scarlett was very popular among both staff and pupils and that her absence would be deeply felt.

The collision occurred while Scarlett and other children were on a community centre’s summer scheme trip, adding to the tragedy of the event.
